HMO licensing in West Northamptonshire Council

In parts of Northampton and Daventry, a home shared by 3 or more people from 2 or more households who share a kitchen, bathroom or toilet needs an HMO licence under a scheme that began on 24 February 2025. Larger HMOs need one everywhere in West Northamptonshire, and the council runs no selective licensing.[33]

Which licence does a rented home in West Northamptonshire need?

Whether a rented home in West Northamptonshire needs a licence depends on how many people share it and where it is.

  • Mandatory HMO licensing covers homes rented to 5 or more people who form more than one household and share a kitchen, bathroom or toilet, anywhere in West Northamptonshire.[44]
  • Additional HMO licensing covers homes with 3 or more people from 2 or more households sharing facilities, inside the scheme area. The council's scheme started on 24 February 2025 and runs for 5 years.[33] Its area takes in the area of the earlier Northampton scheme, which ran from 1 February 2020 to 31 January 2025, plus further parts of Northampton and Daventry; the council's map (opens in new tab) shows it.[33]
  • Selective licensing of homes let to a single household is not in force. The council says the 2 forms of licensing in the area are mandatory and additional.[33]

A planning rule is not a licence. Across the former Northampton borough, a landlord needs planning permission to turn a house into a small HMO.[33] That does not change whether a home needs a licence.[33]

Subject to statutory exemptions, a large HMO shared by at least five people from more than one household needs a mandatory licence anywhere in England. The property licensing guide sets out the national tests that sit behind every local scheme.[44]

Check West Northamptonshire Council's property licence register

West Northamptonshire Council publishes a redacted version of its HMO register as a PDF list of the licences it has granted that remain in operation. The version online as at October 2026 was dated February 2026, so a licence granted since then may not appear. The full register can be viewed at One Angel Square, Angel Street, Northampton NN1 1ED, by appointment through hmolicensing@westnorthants.gov.uk.[39]

  1. Open the published register. HMO public register (PDF, February 2026) (opens in new tab)[39]
  2. Search the exact address. Save a dated screenshot or download of the result. Councils must keep a register of licences, temporary exemption notices and management orders and make it available for inspection.[46]
  3. Ask about applications and exemptions. A missing entry is a reason to investigate, not proof of an offence, so ask whether a licence, application or exemption covered the dates you rented there.[49]
  4. Report or ask in writing. Email the HMO licensing team. Use the council's report a suspected HMO form (opens in new tab). It accepts anonymous reports, but cannot then tell you the outcome.[39] Ask for a reference number and keep the reply.

What a property licence means in West Northamptonshire

The council's own HMO standards set minimum room sizes, fire safety and amenities, and still differ between its former districts.[41] The Northampton and Daventry guide, which covers the additional licensing area, sets out among other things that:

  • a bedroom for one person must be at least 6.51 square metres, and one for two people at least 10.22 square metres, where there is enough shared living space[41]
  • no room under 4.63 square metres may be used for sleeping[41]
  • in a typical shared house, kitchen doors must be 30-minute fire doors, with interlinked smoke alarms on the escape route and a heat alarm in the kitchen[41]
  • there must be enough kitchens, bathrooms and toilets for the number of people living there

Homes in South Northamptonshire have their own guide; the council says its standards are being unified and are under review.[41]

  • National conditions are the floor. Every licence carries the prescribed conditions on gas, electrics, alarms, tenancy terms and waste, and can last up to five years; the property licensing guide lists them in full.[47]
  • Compare the licence with reality. The register entry or licence may identify the manager, the permitted occupancy and property-specific conditions. Check those details against how the home is actually occupied and managed.
  • Keep separate evidence of hazards. A licence does not establish continuing compliance. Report disrepair or an immediate safety risk separately, and keep photographs, messages and certificates.

If your home may be unlicensed

Start with the address and the dates. A home shared by 3 or 4 people from 2 or more households needed a licence only inside the additional licensing area while a scheme was in force.[33] The earlier Northampton scheme ended on 31 January 2025 and the new one began on 24 February 2025, so none applied in between.[33][39]

  1. Confirm the scheme and dates. Match the address, occupancy and rental period to the designation in force at the time.
  2. Ask the council in writing. Email the HMO licensing team. Ask West Northamptonshire Council whether an effective application or temporary exemption existed and when it took effect.[39]
  3. Check the legal position. An application, an exemption, a reasonable excuse or the identity of the person legally responsible (the "person managing or controlling" the property) can all affect whether an offence is proved.[49]
  4. Preserve the evidence. Keep the tenancy, rent payments, proof of occupation, dated searches and council correspondence.

For a licensing offence committed on or after the 1 May 2026 rule change, a tenant can ask the First-tier Tribunal for up to two years' rent, and normally has two years from the offence to apply. The tenant must prove the offence beyond reasonable doubt, and the tribunal decides any award from the statutory factors and evidence; recovery is never automatic.[50] Older offence periods may be governed by earlier limits. Free housing advice is available from Shelter and Citizens Advice, and local law centres can help with tribunal cases.
