Proceedings for the recovery of a fine which under this Act is recoverable on the summary conviction of the offender may be instituted by . . . the following persons, that is to say—
(a) in the case of proceedings by virtue of section 64(1) of this Act—
(i) the registered society concerned; or
(ii) any member of that society authorised by the society or its committee or by the FCA; or
(iii) other than in Scotland, the FCA;
(b) in the case of proceedings by virtue of section 13(3) of this Act, the registered society concerned;
(ba) in the case of proceedings by virtue of section 61 in respect of neglect or a failure to do any act, or furnish any information, required by the PRA—
(i) the FCA, after notifying the PRA; or
(ii) the PRA, after notifying the FCA;
(c) in any other case—
(i) any person aggrieved; or
(ii) other than in Scotland, the Authority;
and (except in Scotland) no other person may institute such proceedings.
Notwithstanding any limitation on the time for the taking of proceedings contained in any Act, any proceedings such as are mentioned in subsection (1) of this section which are instituted by the FCA, the PRA or by the Lord Advocatemay be brought at any time within one year of the first discovery of the offence by FCA or the PRA (or the Lord Advocate, as the case may be), but not in any case more than three years after the commission of the offence.
