Section 51B: Effect of amendment notice

Part II: Supervision of Building Work etc. otherwise than by building control authorities

For the purposes of the enactments specified in section 48(3) above—

the giving of an amendment notice accompanied by such plans as are referred to in section 51A(2)(b) above shall be treated as the deposit of plans making of an application for building control approval,
the acceptance or rejection of an amendment notice shall be treated as the passing, or, as the case may be, the rejection of plans approval or rejection of the application,
where an initial notice is varied by an amendment notice, the deposited plans plans treated as accompanying the application for building control approval shall be treated—
as including the plans accompanying the amendment notice, and
as excluding such of the plans previously treated as the deposited plans accompanying the application as are superseded by the plans accompanying the amendment notice, and
where an initial notice has been varied by an amendment notice, the cancellation of the initial notice under section 52(5) below shall be treated as a declaration under section 32 above that the deposit of plans constituted by the giving of the amendment notice is of no effect. and the initial notice ceases to be in force under section 53A, the application for building control approval (treated by virtue of paragraph (a) as made) is to be treated as if it was not made (and the approval was not given).
