Part VII: Documentary Evidence in Criminal Proceedings

In this Part of this Act—

  • "copy", in relation to a document, means anything onto which information recorded in the document has been copied, by whatever means and whether directly or indirectly, and "statement" means any representation of fact, however made; and

  • "proceedings" means criminal proceedings, including service proceedings.

In subsection (1) "service proceedings" means proceedings before a court (other than a civilian court) in respect of a service offence; and "service offence" and "civilian court" here have the same meanings as in the Armed Forces Act 2006.

Nothing in this Part of this Act shall prejudice any power of a court to exclude evidence (whether by preventing questions from being put or otherwise) at its discretion.
