Section 8: Punishment of contraventions.

An individual who contravenes section 1, 2, 4 or 5 is liable—

on conviction on indictment to imprisonment for a term not exceeding 7 years or a fine, or both, and
on summary conviction to imprisonment for a term not exceeding 6 months or a fine not exceeding the statutory maximum, or both.

Proceedings for an offence under this section shall not be instituted in England and Wales except by, or with the consent of, the Secretary of State or the Director of Public Prosecutions.

No transaction is void or voidable by reason only that it was entered into in contravention of section 1, 2, 4 or 5.
