Part II: Public Supply or Works Contracts

A public authority which maintains an approved list shall not require a person to pay any sum as a condition of his inclusion or continued inclusion in the list or of his being considered for such inclusion.

Subsection (1) above does not create an offence but a contravention of it is actionable by the person seeking to be included or retained in the list.

Expressions used in this section and section 17 above have the same meaning in this section as in that section.
