Where a demand for the purposes of section 52(2) above has been made to a water undertaker in respect of any premises ("the relevant premises"), the undertaker may make compliance with one or more of the requirements specified in subsection (2) below a condition of providing his first supply of water in compliance with that demand.
The requirements mentioned in subsection (1) above are—
of such of the requirements of regulations under section 74 below as are prescribed for the purposes of this subsection; and
Any dispute between a water undertaker and any other person as to whether the expenses referred to in subsection (2)(a)(ii) above were incurred reasonably may be referred to the Authority for determination under section 30A above by either party to the dispute.
Any dispute between a water undertaker and any other person as to whether any requirement of a kind mentioned in subsection (2)(a) or (b) above has been complied with may be referred to the Authority for determination under section 30A above by either party to the dispute.
This section shall be without prejudice to the provisions of sections 233 and 372 of the Insolvency Act 1986 (conditions of supply after insolvency).
