Part I: Arbitration pursuant to an arbitration agreement

Where the time for making an award is limited by or in pursuance of the arbitration agreement, then, unless otherwise agreed by the parties, the court may in accordance with the following provisions by order extend that time.

An application for an order under this section may be made—

by the tribunal (upon notice to the parties), or
by any party to the proceedings (upon notice to the tribunal and the other parties),

but only after exhausting any available arbitral process for obtaining an extension of time.

The court shall only make an order if satisfied that a substantial injustice would otherwise be done.

The court may extend the time for such period and on such terms as it thinks fit, and may do so whether or not the time previously fixed (by or under the agreement or by a previous order) has expired.

The leave of the court is required for any appeal from a decision of the court under this section.
