Financial Services and Markets Act 2000 · 2000 c. 8View on legislation.gov.uk

Part XVII: Collective Investment Schemes — Chapter V: Recognised Overseas Schemes

An application for recognition of a collective investment scheme under section 271A—

must be made in such manner as the FCA may direct,
must contain the address of a place in the United Kingdom for service of notices, or other documents, required or authorised to be served on the operator under this Act, and
must contain or be accompanied by such information as the FCA may reasonably require for the purpose of determining the application.

Where requirements imposed by regulations under section 271E would apply to the scheme or its operator if the application were granted, the application must contain an explanation of how each requirement would be satisfied.

At any time after the application is received and before it is determined, the FCA may require the applicant to provide it with such further information as it reasonably considers necessary to enable it to determine the application.

The FCA may require the applicant to present information provided under this section in such form, or to verify the information in such a way, as the FCA may direct.

Different directions may be given, and different requirements imposed, in relation to different applications.
