A relevant disclosure made in good faith does not breach—
however imposed.
But a relevant disclosure may not include information obtained from a UK law enforcement agency unless that agency consents to the disclosure.
In a case where a person is acting on behalf of another ("the undertaking") as a nominated officer—
Subsection (1) applies whether or not the conditions in section 339ZB were met in respect of the disclosure if the person making the disclosure did so in the reasonable belief that the conditions were met.
In this section—
"relevant disclosure" means any disclosure made in compliance, or intended compliance, with section 339ZB;
"UK law enforcement agency" means—
(a)the National Crime Agency;
(b)a police force in England, Scotland, Northern Ireland or Wales;
(c)any other person operating in England, Scotland, Northern Ireland or Wales charged with the duty of preventing, detecting, investigating or prosecuting offences.
