Section 396DB: Extension of period pending determination of proceedings etc, Proceeds of Crime Act 2002

Subsection (2) applies where—

an application is made to the Court of Session under section 396DA for the extension (or further extension) of the determination period, and

the period would (apart from that subsection) end before the Court determines the application or it is otherwise disposed of.

The determination period is extended from the time when it would otherwise end until—

the Court determines the application or it is otherwise disposed of, or

if earlier, the end of the period of 31 days beginning with the day after that on which the period would otherwise have ended.

Subsection (4) applies where—

proceedings on an appeal in respect of a decision on an application under section 396DA have been brought, and

the determination period would (apart from that subsection) end before the proceedings are finally determined or otherwise disposed of.

The determination period is extended from the time when it would otherwise end until—

the proceedings are finally determined or otherwise disposed of, or

if earlier, the end of the period mentioned in subsection (2)(b).

Subsection (6) applies where—

an application is made to the Court under section 396DA for an extension of the determination period,

the Court refuses to grant the application, and

the period would (apart from that subsection) end before the end of the 5 day period.

The determination period is extended from the time when it would otherwise end until—

the end of the 5 day period, or

if proceedings on an appeal against the decision are brought before the end of the 5 day period, the time when those proceedings are brought.

The "5 day period" is the period of 5 working days beginning with the day on which the Court refuses to grant the application; and for these purposes "working day" means a day other than—

a Saturday or a Sunday, or

a day which is a bank holiday under the Banking and Financial Dealings Act 1971 in Scotland.

The restriction on the overall extension of the determination period mentioned in section 396DA(5) applies to an extension of the period in accordance with any provision of this section as it applies to an extension under an order of the Court.
