Part 1A: Premises associated with persistent disorder or nuisance

This section applies if a magistrates' court makes an order under section 11B.

A relevant person may—

enter the premises in respect of which the order is made;
do anything reasonably necessary to secure the premises against entry by any person.

A person acting under subsection (2) may use reasonable force.

But a relevant person seeking to enter the premises for the purposes of subsection (2) must, if required to do so by or on behalf of the owner, occupier or other person in charge of the premises, produce evidence of his identity and authority before entering the premises.

A relevant person may also enter the premises at any time while the order has effect for the purpose of carrying out essential maintenance of or repairs to the premises.

In this section “a relevant person”—

in relation to premises in respect of which a police Part 1A closure order has effect, means a constable or a person authorised by the appropriate chief officer;
in relation to premises in respect of which a local authority Part 1A closure order has effect, means a person authorised by the local authority.
