A licensing authority may institute criminal proceedings in respect of an offence under any of the following provisions of this Act—
section 37,
section 185,
section 186,
section 229,
section 242,
section 258,
section 259,
section 260,
section 261,
section 262,
section 326,
section 342,
paragraph 20 of Schedule 10,
paragraph 10 of Schedule 13, and
paragraph 20 of Schedule 14.
This section is without prejudice to section 222 of the Local Government Act 1972 (c. 70) (power of local authorities to prosecute or defend legal proceedings).
This section shall not apply to an authority in Scotland.
