Section 940A: Disregard of website failures beyond control of company

Part 27: Mergers and divisions of public companies — Chapter 4: Supplementary provisions

A failure to make information or a document available on the website throughout a period specified in any of the provisions mentioned in subsection (2) is to be disregarded if—

it is made available on the website for part of that period, and
the failure to make it available throughout that period is wholly attributable to circumstances that it would not be reasonable to have expected the company to prevent or avoid.

The provisions referred to above are—

section 906A(6),
section 911A(4),
section 916(3B) and (4B),
section 917(3B) and (4B),
section 918(2B) and (3B),
section 921A(6),
section 926A(4),
section 931(3B) and (4B), and
section 932(2B) and (3B).
