Part 2: Regulation of Social Housing — Chapter 7: Enforcement powers

A pre-penalty warning must specify a period during which the registered provider may make representations to the regulator.

The period must—

be a period of at least 28 days, and
begin with the date on which the registered provider receives the pre-penalty warning.

Representations may concern—

whether a penalty should be imposed;
the amount of any penalty that may be imposed.

After the end of the period specified under subsection (1) the regulator shall—

consider any representations made, and
decide whether to impose a penalty.
