Part 2: Social workers etc in England

The Secretary of State may by regulations create offences in connection with—

registration in a register mentioned in section 39;
prohibitions or restrictions imposed under section 40 (restrictions on practice and protected titles);
failing to comply with a requirement to provide documents or other information or to attend and give evidence under regulations under section 39 or 44;
providing false or misleading information or evidence in response to a requirement under regulations under section 39 or 44.

The regulations—

must provide for the offences to be triable summarily only, and
may not provide for the offences to be punishable with imprisonment.
