Part 4: Exercise of court's discretion — CHAPTER 3: Seriousness and determining sentence

Where a court is considering the seriousness of any offence, it must consider—

the offender's culpability in committing the offence, and
any harm which the offence—
caused,
was intended to cause, or
might foreseeably have caused.
