Part 3: Powers for dealing with domestic abuse

The court may make a domestic abuse protection order under section 28 or 31 against a person (“P”) if conditions A and B are met.

Condition A is that the court is satisfied on the balance of probabilities that P has been abusive towards a person aged 16 or over to whom P is personally connected.

Condition B is that the order is necessary and proportionate to protect that person from domestic abuse, or the risk of domestic abuse, carried out by P.

It does not matter—

whether the abusive behaviour referred to in subsection (2) took place in England and Wales or elsewhere, or
whether it took place before or after the coming into force of this section.

A domestic abuse protection order may not be made against a person who is under the age of 18.
