Section 49: Offence of purporting to act as authorised to exercise enforcement function

Part 1: Product security — CHAPTER 3: Enforcement

A person who is not authorised to exercise a function of the Secretary of State under this Chapter commits an offence if the person purports to act as a person who is so authorised.

A person guilty of an offence under this section is liable—

on summary conviction in England and Wales, to a fine;
on summary conviction in Scotland, to a fine not exceeding level 5 on the standard scale;
on summary conviction in Northern Ireland, to a fine not exceeding level 5 on the standard scale.
