Regulation 7: Statutory charge in favour of Lord Chancellor or provider

Part 2: OPERATION OF THE STATUTORY CHARGE

The statutory charge is in favour of the Lord Chancellor except in the circumstances described in paragraph (2).

The statutory charge is in favour of the provider where—

regulation 4(3) applies; and
no certificate has been issued in connection with the same proceedings or dispute.
