Regulation 28: Discretion to disregard restrained assets

Part 2: Civil legal aid for legal persons — CHAPTER 3: Calculation of disposable income and disposable capital

Where an application is made for legal representation, in calculating the resources of the legal person, any capital resource may be disregarded where—

the legal person is restrained from dealing with that resource by order of the court;
the legal person has requested the court which made the order to release all or part of that resource for use in connection with the proceedings to which the application relates; and
that request has been refused.
