Regulation 34: Financial eligibility: application for a determination

Part 3: Criminal legal aid for legal persons

Subject to paragraph (2), the Director must treat a legal person as having financial resources which are such that the legal person is not eligible for criminal legal aid.

The Director must not determine that the legal person's financial resources are such that the legal person is eligible for criminal legal aid unless—

the Director is satisfied that the legal person is not able reasonably to obtain from any source sufficient means to fund the services in relation to which an application for criminal legal aid has been made; and
the legal person has provided to the Director a document which sets out the likely costs of the services in relation to which an application for criminal legal aid has been made, in accordance with paragraph (3).

If the advice and assistance or representation will be provided on more than one occasion the document provided under sub-paragraph (2)(b) must itemise the cost of the advice and assistance or representation to be provided at each stage of the case.
