Regulation 12: Security for costs

Part 3: COSTS ORDERS AGAINST A LEGALLY AIDED PARTY AND THE LORD CHANCELLOR

Where in any proceedings a legally aided party is required to give security for costs, the amount of that security must not exceed the amount (if any) which is reasonable having regard to all the circumstances, including—

the legally aided party’s resources; and
the legally aided party’s conduct in connection with the dispute to which the proceedings relate.

For the purposes of this regulation, the resources of the legally aided party’s partner are not to be treated as the resources of the legally aided party.
