Regulation 18: Determination of an application

Part 2: Tenants' energy efficiency improvements — CHAPTER 4: Enforcement

The First-tier Tribunal must determine whether—

the landlord's, or the superior landlord's, refusal of consent,
the landlord's initial response,
the landlord's full response,
the counter proposal, or
the landlord's failure to make energy efficiency improvements specified in a counter proposal,

failed to comply with these Regulations.

If the First-tier Tribunal determines that the landlord, or the superior landlord (as the case may be), has failed to comply with these Regulations in any manner referred to in paragraph (1), the First-tier Tribunal may by Order consent to the making of any relevant energy efficiency improvement specified in the tenant's request.
