No term of an occupation contract is enforceable against the contract-holder before the earlier of—
(a) the landlord giving the contract-holder a written statement of the contract under section 31(1), and
(b) the occupation date.
If there is a change in the identity of the contract-holder under an occupation contract, no term of the occupation contract is enforceable against the new contract-holder before the earlier of—
(a) the landlord giving the new contract-holder a written statement of the contract under section 31(2), and
(b) the day on which the new contract-holder becomes entitled to occupy the dwelling.
