The Court of Appeal may, subject to section 25 of the Criminal Justice and Public Order Act 1994, if it seems fit, on the application of a person appealing or applying for leave to appeal to the Supreme Court, other than a person appealing or applying for leave to appeal from a decision on an appeal under Part 9 of the Criminal Justice Act 2003 or section 9(11) of the Criminal Justice Act 1987 or section 35 of the Criminal Procedure and Investigations Act 1996 (appeals against orders or rulings at preparatory hearings), or section 47 of the Criminal Justice Act 2003 grant him bail pending the determination of his appeal.
