A married woman has power by deed to disclaim any estate or interest in land with or without the concurrence of her husband as the case may require.

A husband is not a necessary party to any disclaimer by his wife where—

the wife, if there were no disclaimer, would have been entitled to the property for her separate use or as her separate property; or
the property consists of a trust estate.
